IN THE BIN LIMITED

TERMS OF BUSINESS

These Terms of Business will apply in relation to all services carried out by us for you, our client.

OUR SERVICES

The services that we provide for you will be set out in the contract between us.

OUR CLEANING OPERATIVES

We use cleaning operatives who are known to us and/or have good references, our aim being to ensure that all our personnel are reliable, discreet and honest.

CONTRACT PERIOD

The initial period of the contract will be set out in the Form of Agreement. It will then continue until either you or we give written notice to the other to bring it to an end as set out in the Termination section below.

ACCESS

You will ensure that our staff have access to enable them to collect your wheelie bin(s) during our normal working hours. Bins must be left empty of rubbish on the day fixed for collection.

If any bin is not normally accessible from the street, you must arrange for it to be accessible on the scheduled cleaning day. If we are unable to collect a bin(s) on the due date or if it is not empty of rubbish we reserve the right to make an extra charge if another visit is required.

PRICES & PAYMENT

Our prices will be set out in the Form of Agreement we issue to you. Unless otherwise specified, we will request payment for either a 3/6/12 month contract from you a month in advance and invoices are due for payment within 7 days from the invoice date. We may require that payment is made by credit or debit card and you should complete your card details when requested.

We reserve the right to increase our prices and you will be given at least one month's notice of any increase. You may terminate the Contract by giving us at least 7 days notice before the new prices come into effect.

CANCELLATION

You have the right to cancel the contract as specified in the Form of Agreement. If you wish to exercise this right you must do so in writing. (Please note that this right of cancellation does not apply if you are a business). If you wish to cancel the contract at a later date you should give us at least 7 days notice - please see the Termination section below.

MAINTAINING AND MONITORING STANDARDS

To monitor standards we keep in regular communication with each client. Feedback is always welcome. If for any reason you are not entirely happy with our service, please let us know promptly and we will work with you to overcome any problems.

TERMINATION

Either you or we may terminate the contract between us by giving not less than 7 days' notice in writing. If you give less than 7 days' notice, you will be liable for charges from the date we receive the notice to the end of the 7 day period.

We may give you notice in writing to terminate the contract at any time if you fail to make any payment within 21 days of the due date or you commit any other breach of the contract or you act in any way that is unacceptable to us or any of our staff.

FORCE MAJEURE

If for any reason beyond our control including unavailability of personnel we are unable to provide any services to you (a 'force majeure' event), we will notify you as soon as practicable and we will take all reasonable steps to overcome the problem and resume our obligations, but we will not have any liability to you while the force majeure continues.

INSURANCE, LOSS & DAMAGE

We maintain employers' liability insurance and public liability insurance. In the case of loss or damage to your property which is caused by a member of our staff, you must notify us within 48 hours with details and the matter may be referred to our insurers to deal with.

LIMITATION OF LIABILITY

In the case of loss or damage to your property we shall not be liable for a loss that is fully covered by your own insurance. In other cases, our liability will be limited to paying you the amount of any insurance proceeds for the loss that we recover from our insurers plus the excess on our policy.

Our total liability for breach of contract or negligence will be limited to an amount equal to three months' charges net of VAT.

We shall have no liability (in contract or in tort) to you or any member of your household for any economic loss or any other indirect or consequential loss. However, our liability for death or injury caused by our negligence is not limited.

LAW & DISPUTES

English law applies and the English courts will finally decide any dispute that be settled directly through negotiation.

Either of us may require that a dispute is referred to mediation before it goes to court. In that case, unless otherwise agreed, the mediation will be conducted in accordance with the CEDR (Centre for Effective Dispute Resolution) Rules then in force.
